5th Day of Fast of Anna Hazare – Government trying to find ways not to make a strong Lokpal Bill –

5th Day of Fast of Anna Hazare – Government trying to find ways not to make a strong Lokpal Bill –

Today it’s the 5th day of fast.

Anna is fighting for India; Anna is not fighting for any particular caste or religion.

Every Indian is suffering from the disease called as Corruption.

Anna Hazare said that he will nor relent till the Jan Lokpal Bill is cleared.

"Why should we fight? The funds in government treasuries are ours. The treasuries are not threatened by thieves but by those who guards it. The country is not betrayed by enemies but by these traitors,"

The Parliament's Standing Committee on personnel, public grievances, law and justice,

Which is to suggest amendments to the Lokpal Bill has placed an advertisement in Saturday's newspapers calling for views from the public on the Lokpal Bill.

After Anna Hazare fast the advertisement has come,

This will just delay the bill and government will get chance to say no time, next year or in a winter session we can pass this bill.

The people who wish to express their views on the Lokpal draft are required to send their

response within the next fifteen days starting Saturday.

The response can be either in English or Hindi and has to be addressed to Shri KP Singh,

Director, Rajya Sabha Secretariat, 201, Second Floor, Parliament House Annexe, New

Delhi-110001.

The advertisement says that those willing to appear before the standing Committee should mention that in their response.

"Those desirous of submitting memoranda to the Committee may send two copies thereof, neatly typed in double space (either in English or Hindi) to Shri KP Singh, Director, Rajya Sabha Secretariat, 201,Second Floor, Parliament House Annexe, New Delhi-110001 (Tel:23034201, Fax: 23016784,

E-mail:kpsingh@sansad.nic.in and rs-cpers@sansad.nic.in)

within fifteen days of publication of this advertisement.

Those who are willing to appear before the Committee for oral evidence besides submitting the memorandum may so indicate. However, the Committee’s decision in this regard shall be final," the advertisement says.

Government is expecting that for few days Indians will support Anna Hazare then no one will be seen around Anna Hazare and thus the demand of Strong Lokpal Bill will get killed automatically.

Thus I will request you if possible encourage everyone to join Anna Hazare at Ramlila Maidan.

Government will say that we do not have time, remember the politicians pass their salary raise bill in one second.

Politicians pass their pension bill in a second.

Remember these same politicians pass the 15 Bills and laws in one minute which benefit the big corporations.

Now when the time comes to pass the laws which benefit Indians government has no time.

If you not speak on facebook, twitter and ask your friends why they are ignoring the cause of corruption, Janlokpal Bill.

If you can not go on fast then please stop watching entertainment channels only watch Anna Hazare coverage, talk about Lokpal Bill and Janlokpal Bill.

Forget to which political party you belong no one is superior to India and Indian constitution.

Political parties are our servants they must make the good laws, strong laws, and laws to which criminals will fear and not the honest people.

Think for the future

Do not be a political slave.

Report on 4th Day of Fast Anna Hazare addresses nation - You should not allow this torch of struggle to be put out whether Anna is alive or not

Report on 4th Day of Fast Anna Hazare addresses nation - You should not allow this torch of struggle to be put out whether Anna is alive or not

On the fourth day of his fast Anna Hazare said that "I have taken a decision of my life...if Jan Lokpal Bill is not brought in the Monsoon Session, then I will continue my fast beyond 21 days,"

Arvind Kejriwal said, that now we are willing to have discussion with the Government with open mind if they are willing to suggest a better way of fighting corruption. But we are not willing to compromise on formula, which says leave 20 per cent of corrupt people without any institution, which investigates them for corruption. That kind of compromise is not acceptable to us."

Kejriwal said that no politician would be allowed to share the stage with Anna Hazare.

Last 4 days Anna has not eaten.

Anna reached the Ramlila Maidan almost three hours after he walked out of the Tihar Jail at 11:40 AM on Friday morning.

Anna left Tihar Jail at 11.40 am and made his way atop a truck to Rajghat and India Gate before arriving at Ramlila Maidan.

At Ramlila Maidan Anna addressed the crowd and said that

"The countrymen should not lose this spirit. This is our fight against corruption. I have lost 3 kg but I am getting energy from my supporters across the country. I have full faith in my country. This government has looted the country. We will now only sit in peace when the corruption gets removed from the country. Till Jan Lokpal Bill is passed, we will not leave Ramlila Maidan," announced Hazare as thousands of his supporters waved the Indian flag and shouted slogans in his favor.

"You should not allow this torch of struggle to be put out whether Anna is alive or not,"

He was checked by cardiovascular and cardiothoracic surgeon Dr Naresh Trehan at the Ramlila Maidan.

He had also undergone a medical examination on Friday morning with the doctors declaring that he had lost 3 kgs in three days and weighed 68 kg.

Anna weighed 71 kg when he was arrested and sent to the Tihar Jail.

A team of 36 doctors, assisted by Dr Naresh Trehan, would be monitoring the health of Anna Hazare round the clock during his hunger strike.

While talking with CNN-IBN BJP leader Varun Gandhi said that next week he will introduce Team Anna's draft Jan Lokpal Bill in the Lok Sabha

NDTV reported that Independent Rajya Sabha member Rajeev Chandraskehar submitted a copy of Anna's draft Bill as a Private Member's Bill for tabling on August 8.

The Chairman of the Rajya Sabha will check the bill and send it to President Pratibha Patil for consent. If she gives her consent then it can be taken up in Parliament after a month.

The Monsoon session ends on September 8.

Private Members' Bills are taken up for discussion in the Parliament in the second half of every Friday and since September 8 is a Thursday, Janlokpal Bill will miss the date and it can be taken up only in winter session.

Sopan Laxman Mare, President of the Mumbai Lunch Box Suppliers Association, said the dabbawalas, would go on strike for the first time in their 120-year history.

We have already pledged our support to Anna Hazare.

He is fighting against corruption for the people of the country. 5000 dabbawalas and 200,000 customers will go on strike on Friday in support of Anna's movement.

After 4 days few congress leaders accepted that arresting Anna was a mistake.

Sandeep Dikshit who is the son of Delhi Chief Minister Sheila Dikshit and Lok Sabha MP from the East Delhi constituency said that "It was a mistake to arrest Anna Hazare. The government has realized that it's a mistake and rectified it. I would want that the way he (Anna) has supported the public, he should also guide the government and help break this impasse,"

Kiran Bedi said that Delhi Police, the Anna team and MCD would work together to prepare the Ramlila Ground for Hazare's protest.

Arvind Kejriwal told to TOI that Anna Hazare will leave Tihar only when the Ramlila ground is ready. He will not move anywhere else. He will move straight from the jail to the Ramlila Maidan.

READ MORE - Anna Hazare and Government agree Anna will go on fast for 15 days if required will go on fast for more days at Ramleela Maidan

Anna Hazare - One Demand Remaining Government Accepted 5 demands More than 45 Hours Anna Hazare is on Fast

Anna Hazare - One Demand Remaining Government Accepted 5 demands More than 40 Hours Anna Hazare is on Fast

First Government said accept the 22 conditions, Anna Hazare accepted 16 and did not accept other conditions.

Then Government arrested Anna Hazare, took him to Tihar Jail. Anna Was given 7 days judicial custody by magistrate as Anna did not take the bail.

After that Anna appealed to Indians to come out and show him support and fill the jails.

Every Indian has a right to do agitation; every Indian has a right to protest.

Just like Gandhi, Anna Hazare said follow the peaceful methods and in last 48 Hours nothing happened all protests were peaceful, more and more Indians staying in India or who are staying in other countries started to support Anna Hazare.

When Government saw the millions of Indians are joining and supporting Anna, after his arrest in few hours Government applied to judge and got the released orders of Anna Hazare.

Anna Said now I will go to JP Park and continue my fast and protest again government said no.

After few hours government started to accept the conditions one by one, the conditions are very simple and reasonable, Government should not say no to such conditions.

What are the six conditions and which 5 Conditions Government accepted?

1. Number of People – First government said only 4000 people can join the fast. Now government has agreed to that as per the capacity of location the people can join. Ramlila Maidan can hold approximately 25,000 people thus No limitation on number of people

2. Permission to do fast

3. Government agreed to allow parking of vehicles till the parking is full. First government said only limited parking area will be given. No limit on number of cars and two wheelers.

4. No loud speaker – Now Government said that loud speaker will be allowed as per Supreme Court of India guidelines that is up to 10 PM loud speaker will be allowed.

5. Government agreed that there will be one government doctor and one doctor will be from Team Anna

Now only one demand is remaining how many days Anna Hazare should go on strike?

Government should not decide this for Anna Hazare, the demand of Anna Hazare is right.

Kiran Bedi said that "Delhi Police want dharna to end as soon as fast ends, but we want dharna to continue. Team Anna is discussing this issue with police,"

Further she said that "There are differences between us and the Government on the number of days of fast to be carried out. We have asked for 30 days, but they have only permitted for seven days so far."

Anna will take time to come out.

Anna wants a written approval for the venue from government.

Let us hope Congress will introduce Janlokapl Bill in parliament and will discuss it.

An Open Letter to Every One Who is Opposing Janlokpal Bill and Anna Hazare

An Open Letter to Every One Who is Opposing Janlokpal Bill and Anna Hazare

Today in India many educated Indian citizens are opposing the Janlokpal Bill?

Do you know How India got the right to information act?

Anna Hazare gave us Indians the right to information Act.

Today why Ministers are in Jail?

Not because government wanted or police wanted only when Supreme Court showed anger everyone started to work?

Why we do not have the right to know the names of Black Money owners?

Few people say that Prime Minister should not come under Lokpal?

Why not?

Can you guarantee that we will never get the bad and corrupt prime minister of India?

Do you know Directive Principals of Indian Constitution?

Those are supposed to be laws of India not just guidelines?

Do you know Supreme Court of India ordered Police Reform?

If yes then do you know which political party or government implemented it?

Do you know many countries got Prime Minister under Lokpal?

Do you know Prime Minister comes under the prevention of Corruption Act and income tax law?

Do you know as per Indian Constitution we got equality before the law?

Do you know Janlokpal Bill or did you read it?

An ordinary citizen can also demand the removal of Lokpal.

Few People say we got already laws so we do not need them?

Just think why they are not implemented?

Reason is simple uncontrolled powers enjoyed by Politicians.

Do you know if any person files a wrong case he will get fined or jailed?

Lokpal will be team of 11 members.

Now Please tell me what is wrong in Janlokpal Bill?

Read, Understand and then talk.

About which Parliament you are talking?

The parliament in which criminals are sitting?

Why politicians do not make laws which will ban them from contesting elections.

Why there is delay in every case?

The reason is simple Read and Understand the Legal History of India.

British made the laws to benefit the British queen and British people.

British left India They passed the law Transfer of Power then we got Independence.

After that the ruler got changed but our system remained same benefiting the rulers.

What British People did not do it our own Indians did it?

Just compare how much British Looted and How much our Indians looted in 64 Year?

India got robbed more than British rule in its own Indian rule.

What is wrong in demanding good and strict laws?

Do you remember Gandhi and Dr. Babasaheb Pact?

Our system of laws is making every Indian Corrupt we are not corrupt.

Thus the time has come to change the system and bring good laws, strict laws and accountability on politicians, retirement age for politicians, negative voting, police reforms and many more

As in Last 64 Years we got nothing.

What ever India got it happened because of Supreme Court of India or the people like Anna Hazare fought with government.

Do not be a slave of political Machinery

Learn to think and ask WHY corruption is rising?

Don’t you feel ashamed that our India ranks higher in corruption Index?

Do you know any person in India who has not paid the bribe?

Even giving the pack of sweets to government officer is a bribe.

Just open your eyes and understand the situation

If Janlokpal Bill is passed by government it will reduce the corruption more than 70% in few years.

If government lokpal Bill is passed remember corruption will increase it wont get decrease. Not single percent will get reduced.

Janlokpal Bill Versus Congress Govt. Lokpal Bill - Know the difference on 25 Points between Janlokpal Bill and Govt. Lokpal Bill

Janlokpal Bill Versus Congress Govt. Lokpal Bill - Know the difference on 25 Points between Janlokpal Bill and Govt. Lokpal Bill

Today many educated Indians who are in reality uneducated are misguiding the Indians regarding the Janlokpal Bill.

So now please compare the Anna Hazare team made Janlokpal Bill and Government made Lokpal Bill.

Compare the Lokpal Bill and understand which Lokpal Bill will reduce the corruption in India.

1-

Government’s Lokpal –

Directed against those who raise their voice against corruption?

[Section 17 (1) (e) of Govt Bill]

Jurisdiction –

Only 65,000 people out of 1.2 crore

Only Group Central Govt employees

Instead of ALL Govt employees

All NGOs, Societies, Trusts, even unregistered

2-

Government’s Lokpal

[Section 50, 51 of Govt Bill]

Provides illegitimate protection to the corrupt officials?

If a citizen complains against a govt officer’s corruption to Lokpal…

•Govt officer can file a Cross Complaint directly to the Special Court

Without Preliminary Enquiry that whether complain was frivolous

•Govt officer given free advocate while the Citizen has to defend himself If complain proved frivolous citizen gets minimum 2 years jail

•If corruption of Govt officer proved –gets minimum 6 months jail

3-

Government’s Lokpal-

Section 23, 24 of Govt Bill -

Pro-accused investigation process?

After preliminary enquiry, accused given a hearing before filing an FIR

To explain why an FIR should not be registered against him.

After completion of investigations, presented evidence & again given a hearing

To explain why a case should not be filed in the court

During investigations, if investigations are to be started against any new persons,

They too would be presented with evidence against them & given hearing

Increased risk to whistleblowers

Nowhere else in the world is Criminal Jurisprudence like this!

4-

Critical Issues –Prime Minister

Government’s Draft –

PM kept out of Lokpal’s purview

Jan Lokpal Draft –

Lokpal should have power to investigate allegations of corruption against PM.

Special safeguards provided against frivolous & mischievous complaints

CORRUPTION by PM can be investigated, under Prevention of Corruption Act

Govt wants investigations to be done by CBI which comes directly under him, rather than independent Lokpal

As per Indian Constitution we got equality, in the eyes of law every citizen is equal no one is above the law.

Then how come an Indian citizen SERVANT Prime Minister will not obey and follow the law of Lokpal.

5-

Critical Issues –Judiciary

Government’s Draft –

Judiciary kept out of Lokpal’s purview.

Government wants it to be included in Judicial Accountability Bill (JAB)

In JAB permission to enquire against a judge will be given by a three member

Committee, Two judges & a retd Chief justice of the SAME court)

If only a strong and effective JAB were considered & enacted simultaneously

Judicial Accountability Bill (JA B), drafted by the government, does not

Talk of bribery by the judges. It only talks of “misbehavior”.

National Oversight Committee sought to be created through JAB will not

Have the police and investigative powers and machinery to deal with

Criminal complaints of bribery, which Lokpal would have. Therefore, the

Two bills actually complement each other.

Even if judicial corruption were included in JAB, it is not clear when

Would an effective JAB become a reality? Should we wait endlessly till?

JAB became a reality?

Jan Lokpal Draft –

Lokpal should have power to investigate allegations of corruption against Judiciary.

Special safeguards provided against frivolous & mischievous complaints

6-

Critical Issues –MPs

Government’s Draft –

Government has excluded this from Lokpal’s purview.

Article 105(2) gives them Freedom to Vote or Speak in Parliament,

Not Freedom for taking Bribe for it!!!

Govt virtually giving a license to MPs to take bribes with impunity

Strikes at the foundations of our democracy

Jan Lokpal Draft –

Lokpal should be able to investigate allegations that any MP had taken bribe to vote or speak in Parliament

7-

Critical Issues –Grievance Redressal –

Government’s Draft –

No penalties proposed. So, this will remain only on paper

Government had earlier agreed to it – (Joint committee meeting, 23rd May)

Unfortunately have gone back on this decision.

Jan Lokpal Draft –

Violation of CITIZEN’S CHARTER (if an officer does not do a COMMON Man’s work in prescribed time) by an officer should be penalized and should be deemed to be

Corruption.

8-

Critical Issues –CBI

Government’s Draft –

Government wants to retain its hold over CBI.

CBI misused by government. Recently, govt exempted CBI from RTI,

Jan Lokpal Draft –

Anti-corruption branch of CBI should be merged into Lokpal.

9-

Critical Issue – Lokpal Appoint and selection

Government Draft –

With 5 out of 10 members from ruling establishment, 6 politicians in selection committee, ensured that only pliable & weak people be selected

Search committee to be selected by selection committee

No selection process provided.

Governments will be able to appoint its own Lokpal members & Chairperson.

Earlier consensus on Selection committee, Selection process, Disagreement only on composition of search committee – (Joint Committee meeting, 7th May)

Jan Lokpal Draft –

Broad based selection committee with 2 politicians, 4 judges and 2 independent constitutional authorities. An independent search committee consisting of

Retired constitutional authorities to prepare first list. A detailed transparent selection process with PUBLIC PARTICIPATION

10-

Critical Issues –Accountability (Lokpal Members)

Government’s Draft –

Accountable to the Government. Only government can seek removal of Lokpal

Both Selection and Removal of Lokpal in Government’s CONTROL Puppet in government’s hands

Jan Lokpal Draft –

Accountable to the PEOPLE

Any Citizen can make a complaint to Supreme Court and seek removal.

Judicial review over the actions of the Lokpal by the High Courts under Article 226 and the Supreme Court under Article 32 and 136

11.

Critical Issues –Accountability (Lokpal Staff)

Government’s Draft –

Lokpal itself will investigate complaints against its own staff, thus creating serious conflicts of interest

Government’s Lokpal is accountable either to itself or the government.

Jan Lokpal Draft –

Complaint against Lokpal staff will be heard by an independent authority

We suggested accountability of Lokpal directly to PUBLIC

12-

Critical Issues –Method of Enquiry

Government’s Draft –

CrPC being amended Special protection to the accused

•After preliminary enquiry, all evidence provided to the accused & hearing for why an FIR should not be registered against him.

•After completion of investigations, again all evidence provided & hearing for why a case should not be filed against him in the court.

•During investigations, if investigations are to be started against any new persons, they would also be presented with all evidence against them and heard.

Jan Lokpal Draft –

Method would be the same as provided in CrPC like in any other criminal case.

•After preliminary enquiry, an FIR will be registered.

•After investigations, case will be presented before a court, where the trial will take place

13-

Critical Issues –Lokayukta –

Government’s Draft –

Only Lokpal at the centre would be created through this Bill.

Jan Lokpal Draft –

The same bill should provide for Lokpal at centre and Lokayuktas in states

According to Mr. Pranab Mukherjee, some of the CMs have objected

State Information Commissions were also set up under RTI Act through

Single Act only.

14-

Critical Issues –Whistleblower Protection –

Government’s Draft –

No mention in this law

Jan Lokpal Draft –

Lokpal will be required to provide protection to whistleblowers, witnesses

And victims of corruption

Protection for whistleblowers is being provided through a separate law.

That law so bad - Trashed by Standing Committee of Parliament - headed by

Ms Jayanthi Natrajan.

Earlier agreed that Lokpal would be given the duty of providing protection to

Whistleblowers under the other law, & that law would also be discussed & improved in

Joint Committee only (Joint Committee meeting, 23rd May)

15-

Critical Issues –Special Benches in HC

Government’s Draft –

No such provision

One study shows that it takes 25 years at appellate stage in corruption cases.

Jan Lokpal Draft –

High Courts will set up special benches to hear appeals in corruption cases to fast track

Them

16-

Critical Issues –CrPC

Government’s Draft-

Not included

Jan Lokpal Draft-

On the basis of past experience on why anti-corruption cases take a long

Time in courts and why do our agencies lose them, some amendments to CrPC

Have been suggested to prevent frequent stay orders

17-

Critical Issues –Dismissal of Corrupt Government Servant –

Government’s Draft –

The minister will decide whether to remove a corrupt officer or not.

Often, Ministers are beneficiaries of corruption of senior officers

Power of removing corrupt people from jobs should be given to

Independent Lokpal rather than this being decided by the minister in the

Same department.

Jan Lokpal Draft –

After completion of investigations, in addition to filing a case in a court for

Prosecution, bench of Lokpal will hold open hearings and decide whether to remove the government servant from job

18-

Critical Issues –Punishment

Government’s Draft –

None of these accepted. Only maximum punishment raised to 10 years.

Jan Lokpal Draft –

Maximum punishment is ten years

• Higher punishment if rank of accused is higher

• Higher fines if accused are business entities

• If successfully convicted, a business entity should be blacklisted from future

Contracts.

19-

Critical Issues –Financial Independence

Government’s Draft –

Finance ministry will decide the quantum of budget

This seriously compromises with the financial independence of Lokpal

Jan Lokpal Draft –

Lokpal 11 members collectively will decide how much budget they need

20-

Critical Issues –Prevent ongoing Corruption

Government’s Draft –

No such duties and powers of Lokpal

2G is believed to have been known while the process was going on.

Shouldn’t some agency have a duty to take steps to stop

Further corruption rather than just punish people later?

Jan Lokpal Draft –

Lokpal will have a duty to take steps to prevent corruption in any ongoing

Activity, if brought to his notice. If need be, Lokpal will obtain orders from High

Court.

21-

Critical Issues –Tap Phones

Government’s Draft –

Home Secretary would grant permission

Jan Lokpal Draft –

Lokpal bench will grant permission to do so

The right to tap phones is a basic right provided to all Investigation Agencies in the country even now Permission from Home Secretary will compromise investigations.

22-

Critical Issues –Delegation of Powers

Government’s Draft –

All work will be done by 11

Members of Lokpal. Practically no delegation

This is a sure way to kill Lokpal.

Within no time, the members would be overburdened

Jan Lokpal Draft –

Lokpal members will only hear cases against senior officers and politicians or

Cases involving huge amounts. Rest of the work will be done by officers working under Lokpal

23-

Critical Issues –NGOs

Government’s Draft –

All NGOs, big or small, even unregistered, are covered.

A method to arm twist NGOs

About 5 lakh registered NGOs and millions unregistered

Contradicts own logic of not including lower bureaucracy because of large numbers overburdening Lokpal

Jan Lokpal Draft –

Only government funded NGOs covered

24-

Critical Issues –False, Frivolous & Vexatious Complaints

Government’s Draft –

2-5 years of imprisonment& fine

• The accused can file complaint against complainant in a court

• Prosecutor and all expenses of this case will be provided by the government to the accused

• The complainant will also have to pay compensation to the accused

Every accused will harass complainants.

Corrupt people will file cases against complainants and no one will dare file any

Complaint.

Interestingly, Minimum punishment for corruption is 6 months but for

Filing false complaint is 2 years.

Jan Lokpal Draft –

No imprisonment, only fines on complainants.

Lokpal will decide whether a complaint is frivolous or vexatious or false.

25-

Government Lokpal Bill –

Investigation process provided by the government would severely COMPROMISE ALL INVESTIGATIONS

If evidence were made available to the accused at various stages of investigations, it would also REVEAL IDENTITY OF WHISTLEBLOWERS compromising their security

Such a pro-accused process of Criminal Jurisprudence NOWHERE IN THE WORLD

Such process would KILL ALMOST EVERY CASE !!!!

Anna Hazare Janlokpal Bill Versus Government Lokpal Bill – Honesty and Corruption Test on Lokpal Bill

Anna Hazare Janlokpal Bill Versus Government Lokpal Bill – Honesty and Corruption Test on Lokpal Bill

Who is Honest Anna Hazare Janlokpal Bill or Government Lokpal Bill

The purpose of this honesty test is to find which Lokpal bill is good for India that Janlokpal Bill or Congress government Lokpal Bill

After reading this your heart and soul will answer you who is honest and to whom support.

Honesty Test 1

Anna says:

If the job is not done within stipulated time, the concerned

Officer or department head should be fined which should be given to

The complainant as compensation

Government says:

A Citizen’s Charter can be made, but does not

Agree to fine the concerned officer for not having done his job on

Time.

Honesty Test 2

Anna says:

The machinery of Corruption is wired & connected from top

To bottom. Investigating only the top officials will not be enough. The

Common public has to get their work done by the lower ranking officers.

Whatever system the government has to create to fight corruption

Should be done. Must be done.

Government Says:

The Lokpal should investigate corruption charges

Against only Group a level officers (the highest ranking officials),

Because it is not possible for one agency to investigate matters related

To 40 Lakh Central Government Officials.

Honesty Test 3 –

Anna says:

The common man has to deal more with the state

government for their everyday needs, eg. Rashion, Pension, Roads,

Electricity etc. Therefore, only a lokpal at the center will not be

enough. Under the same Lokpal Bill, a Lokayuct should be formed in

every state, which will investigate corruption of state government

employees.

Government says:

The job of controlling corruption in State

Government Offices should be left to the state governments. If the

state government wants; they can make their own Lokayuct. The

government says that as per our constitution, the decision to create a

lokayuct, is under the purview of the state governments.

Honesty Test 4 –

Many times, MP have been accused of taking bribes to vote or ask questions

in the Parliament. Who should investigate these matters?

Anna says:

Investigations into such matters can not be left to the

Member of Parliament's own committees, as there is always a

possibility of favoritism.

This is the reason why, despite serious allegations, no MP has gone to jail. So, the job of independent & fair investigation should be given to the Lokpal. And we should not shy

away from making amendments to the constitution if necessary.

Government Says:

Such investigations can be done only by

Parliamentary Committees as has been happening till now.

As per the constitution, MP’s has this special privilege.

If such matters are investigated by the Lokpal, it will be outside the constitution.

Honesty Test 5 –

If there is an allegation of corruption on a Judge, permission needs to be

taken from the Chief Justice of the Supreme Court before initiating

investigations on that judge.

Anna says:

Despite several matters relating to corruption in the

judiciary in the past 20 years, permission to investigate has been given

in only 2 cases.

This very point makes it clear that judges will never give

permission against their own judge "brothers".

Therefore, the authority to give permission to investigate judges should be given to a 7 member

bench of the Lokpal which will be fair and independent.

Government says:

Correct decision on permission to investigate in matters about judges, can only be taken by judges. Giving this right to the Lokpal, will be a compromise on the independence of the judiciary.

A separate bill is being brought for this. As per this new bill, a

committee of 3 judges of the same court will grant permission to

investigate the accused judge.

Honesty Test 6 –

If the Prime Minister is accused of corruption, the CBI is the investigative

authority today.

Anna says:

The CBI works directly under the Prime Minister's control. So

how can the CBI Investigate its own boss? A system can easily be put in

place to curb petty & baseless allegations.

Government says:

Considering the post of the prime minister, this job

should not be given to the lokpal. Therefore, this work should remain

with the CBI. If there are thousands of complaints against the Prime

Minister, it will become difficult for him to work

Honesty Test 7 –

If an official is fount guilty during investigation, who should have the power

to dismiss him?

Anna says:

Usually, in the corruption case of an official, the

concerned minister is also involved. It has been found that instead of

punishing the corrupt, ministers often give them lucrative postings.

Therefore, they can not take a correct decision on guilty officers. The

power to dismiss a corrupt official should be with the Lokpal. The

minister will still have the power on transfers, postings, promotions

of officials and so the officials will obey his orders.

Government says:

The power to dismiss an official found guilty of

corruption should be with the concerned minister of that

department. As per the government, if the power to dismiss a

corrupt official is given to the Lokpal, the officials will stop obeying

orders of the ministers.

Honesty Test 8 –

Who is Honest Anna Hazare Jan lokpal Bill or Government Lokpal Bill ?

India has to pass one Lokpal Bill

In this honesty test what your heart says

Anna or Government

If your heart says that Anna is right then

Please today that is 15th August 2011 keep your lights of between 8 to 9 PM India time.

And tell everyone Keep the lights off. Do not watch television entertainment channels between 8 to 9 PM India time.

Prime Minister Manmohan Singh replies to letter written by Anna Hazare regarding his fast on 16th August

Delhi police told Anna that, Anna must follow 22 conditions.

After that Anna wrote letter Prime Minister Manmohan Singh.

Anna Hazare in his letter to Prime Minister wrote that

The government's attitude gave a hint of "dictatorship" as those raising voice against it are being "crushed" particularly under his government.

Your Government is trying to crush those who raise their voice against corruption. This is happening more often in your Government.

Demanding Prime Minister intervention Anna wrote that "you are 79-years-old and are holding the nation's top position. You have got everything from life. What else do you want from life? Show courage and take some concrete steps."

Noting that it was the duty of the Prime Minister to protect the Constitution and democracy.

Now Congress Prime Minister Manmohan Singh replied to the letter written by Anna Hazare.

Prime Minister Manmohan Singh told Anna Hazare that "My office does not in any way get involved in the decision-making process,"

Prime Minister said that Anna should go to Delhi police.

Singh said "the terms and conditions on which you are entitled to carry on with your protest are decided by the statutory authorities concerned taking into account the prevailing circumstances and other relevant factors".

Prime Minister said that "we are all committed to the Constitution of India and to uphold it in both letter and spirit".

Below is the full text of the PM's letter:

I have received your letter, carrying the date 14th August, 2011 and carefully read its contents.

Your grievance that the police has given you permission to protest and go on fast at JP Park only for three days needs to be addressed by the statutory authorities who have taken that decision. My Office does not in any way get involved in the decision making process. The terms and conditions on which you are entitled to carry on with your protest are decided by the statutory authorities concerned taking into account the prevailing circumstances and other relevant factors.

I would request you to address your grievances to the statutory authorities concerned.

We are all committed to the Constitution of India and to uphold it both in letter and spirit.

Know the 22 conditions put forward by Delhi Police in a democratic India – is it the murder of democracy

The Delhi Police had sent a letter to Team Anna on Saturday asking them to give an undertaking agreeing to a list of 22 conditions.

A statement by the Delhi Police said, "Due to legal and administrative constraints we have offered them a three day dharna at the park subject to their giving an undertaking that they will vacate the park on the third day evening. We shall permit them once they give this undertaking."

All five members from Team Anna have to sign an undertaking to this condition.

Anna Hazare has rejected them and said he will go on fast.

Anna said that "Our freedom is being taken away on 65th Independence Day".

He said that the fast would be held at the JP Park.

In press conference Anna said that “I will fast irrespective of whether permission is granted or not,” said the veteran Gandhian. “We will not give any undertaking to restrict the fast to three days. The condition of an assembly of not more than 5,000 people is also unacceptable,”

Rejecting the Delhi Police and the government's condition that the number of protesters be limited to 5,000, the Hazare team said when political parties hold protests, lakhs of people are being brought in busess and trucks with which the government has no problem.

"In our protest, people are coming on their own using their own money. The government is acting against them...

People will come and teach the government a lesson," Hazare said while noting that he was not sure how many people will join his protest.

RTI activist Arvind Kejriwal said that they will not sign an undertaking on conditions that they deem to be unconstitutional. Further he said that "We will go to JP Park and try to start our fast. It is up to the government, if they allow us to do the same."

Former Honest female cop Kiran Bedi said that as “a DCP of New Delhi area in Delhi police during the time of emergency in 1975, we had allowed protests. It seems they are getting messages from somewhere else.”

Following are the 22 conditions Delhi Police has put for the Anna Hazare to do a peaceful protest.

1. The Delhi Police has asked Anna Hazare and his followers to file an undertaking before they could give permission to hold a fast at Jai Prakash Narayan Park.

2. The undertaking says that Anna has been granted permission to hold his fast from August 16 to August 18, till 1800 hrs.

3. Only 4000 to 5000 people can attend or join

4. only 50 cars are allowed

5. only 50 bikes are allowed

6. Supporters are channelised and seated in an organized manner

7. Supporters do not spill out on the roads

8. no loudspeaker or public system , should not use loudspeaker or public system

9. All five members from Team Anna have to sign the undertaking to get permission to hold the fast at the venue.

10. not resorting to violence

11. making arrangements for water

12. making arrangements for mobile toilets

13. making arrangements for electricity

14. Not giving inflammatory speeches

15. The fast can be held from 8.00 am, August 16 to 6.00 pm

As I get the other conditions I will update the post

An Open Letter all Member of Parliament an appeal to all MPs From Anna Hazare

An Open Letter all Member of Parliament an appeal to
all MPs From Anna Hazare

Anna Hazare has written an open letter to the MPs making an appeal to them not to allow introduction of a Joke pal that is Lokpal Bill.

Read the letter written by Anna Hazare to all MPs.

Dated: 2nd August 2011

To,

Hon’ble Members of Parliament

Parliament of India

New Delhi

Subject: My sincere appeal to prevent introduction of the anti-poor Lokpal Bill passed by the Cabinet

Dear Hon’ble Members of the Parliament,

Like many of you I have been serving my country to strengthen democracy at the grass roots. Like many of you all my efforts have been focused on reducing the sufferings of the common man, the poor farmer, worker or service person. Again like many of you I have seen from very close quarters how corruption hurts the poor most.

It is only to protect his interests that I volunteered to be a part of the joint drafting committee. I regret to share that many issues which were addressing common man’s persisting concerns have been totally overlooked in the government cleared bill.

Introduction of such a defectively structured bill is an affront to the honorable Parliamentarians, which does not have the option of debating on some of the critical issues that we had raised for a strong anti-corruption Act.

1. A Strong Public Grievance Redressal mechanism – with penalties so that all departments can work effectively to reduce corruption, which is creating so much misery for the poor.

Inclusion of lower bureaucracy under the ambit of the Lokpal – most cases of corruption of poor, farmers, workers and general populace would be in the interaction with the lower bureaucracy. All cases of corruption even at higher level and political levels would not be possible without involvement of the lower officers.

2. Same bill should create a strong, accountable and independent Lokpal as well as Lokayuktas at state level – because many of the corruption cases impacting the poor involve state government officers.

3. Independent selection, funding and removal mechanism to ensure autonomy of function.

4. Strong effective checks and balances to ensure accountability and transparency of the Lokpal and Lok Ayuktas.

5. Many other important issues like the coverage of the PM, Judiciary, MPs in Parliament, dismissal of corrupt officers, strong punishment, and empowerment along with checks and balance of Lokpal etc.

While there are many important issues in the lokpal I write to focus and highlight the plight of the common man yet again being left out.

It is my hope that the institution of the Parliament will continue to uphold its glorious heritage and prevent introduction of such an ANTI POOR bill by the government.

A copy of the comparative statement of our demands vis-à-vis the government draft is enclosed herewith for your perusal.

Yours’ Sincerely,

Anna Hazare

Congress Government Blocks – Anna Fast Says No Permission Delhi Police

Congress Government Blocks – Anna Fast Says No Permission Delhi Police

Now question is Does India is a democratic nation?

Do you think Government will make the Ramdev Baba of Anna?

The Delhi police has said Anna Hazare can’t stage his fast at Jantar Mantar in Delhi.

Anna Hazare has said that he will go to Supreme Court and will try to get permission from Supreme Court of India.

Times now reported that The Delhi Police referred to the Supreme Court's 2009 order to deny team Anna permission for the indefinite strike anywhere in Delhi.

The police, in its letter to Hazare, said that as Parliament would be in session, no group could be allowed to capture the entire space at Jantar Mantar further the letter says that
They could hold their strikes in Delhi's outskirts, or give a definite time limit during which they would be allowed a sit-in protest.

Anna Hazare said that "The entire country will protest with me at Jantar Mantar on August 16.
This is not Hazare's protest but the entire country's. The people need to look at this as a second fight for their freedom and they should all come out on the streets,"

Join and Support Anna Hazare Fight against Corruption from 9th August

Government of Congress has rejected Jan Lokpal Bill and is planning to introduce their own Lokpal, a weak lokpal.

Now we Indians have no hope and no choice, Anna Hazare has no choice but to go on hunger strike from 16th August 2011.

Anna’s fast from 16th August is our last hope. We can’t afford to fail this time. For if we fail, we may never get another chance. Its now or never.

A number of people across the country are planning various protest activities.
You can organize your own or you can participate in any manner possible.

1st August to 9th August:
Many people across the country are forming small teams and undertaking short and long padyatras. They would talk to people on their way, hold meetings, distribute pamphlets

From 9th August:

Mass burning/tearing of government’s Bill as a mark of non-violent protest. Anna will start it most likely from Delhi or Mumbai.

From 9th August to 15th August:

People in villages, towns and mohallas will form teams and go for prabhat pheri in mornings singing patriotic songs and educating people about corruption and Jan Lokpal Bill. In the evening, there would be candle light and mashal marches.

15th August:
Switch off lights from 8 pm to 9 pm on Independence Day as a mark of support for the anti-corruption movement.

Fast starts from 16th August:
Government says they would crush Anna’s fast the way they crushed Baba Ramdev’s movement. We are ready for that. We will offer ourselves for arrest if the government decides to arrest us. We are ready to face their batons and bullets. But we will not move from there. We will not retaliate. It will be a completely non-violent movement.

But if the people take a week off from their work from 16th August and take to the streets- in front of their house, on the crossings, in parks, everywhere – with a tricolor in their hands, raise slogans against corruption – Government can crush one Anna, but it won’t be able to crush 120 crore Annas. Government could impose section 144 on one Jantar mantar. But will it impose curfew on the whole country?

If the whole country takes to streets for a week from 16th August, WE, THE PEOPLE OF INDIA, can force the government to enact a strong Jan Lokpal Bill.

Will you be there? Can we count on your support and active participation?

Still Confused –
Few More Eye opening points about Government Lokpal Bill –

1. The government lokpal bill covers only 0.5% public servants.

2. There are more than 1.25 Crore government servants but only 65,000 Group A Central government servants will come under Lokpal.

3. Government Lokpal will not be allowed to take any action against Sarpanch or BDO but he will control social organizations and common citizens.

4. All the activities of common citizens will be monitored by Lokpal but not the government babus. Durga Puja and Ram Leela programs will be under purview of government lokpal

5. If any citizen files a case against the corrupt officer government will provide him advocate and all expenses but common citizen will be required to spend his own money. In this fight if citizen proves right the corrupt officer will be punished for six months only but suppose citizen fails to prove that the public servant is corrupt then he will go to Jail for 2 Years.

6. No one has power to investigate Prime Minister, they say CBI will do the job, but PM is the boss of CBI.

7. if scam like Cash for vote happens MP will investigate each other do you know the final result of any of such case?

Congress Approved Jokepal Bill made by politicians and Rejected Jan Lokpal Bill prepared by Anna

Congress Approved Jokepal Bill made by politicians and
Rejected Jan Lokpal Bill prepared by Anna

July 28, 2011 should be written as a black day in the history of India,
History will not forgive the corrupt.

Today Congress party approved the bill and all the recommendations of their own politicians and rejected the Jan Lokpal Bill prepared by Anna.

The government version of Jokepal or Lokpal bill has kept Prime Minister and Judiciary
Out of reach of Lokpal.
The cabinet decided that the Bill does not apply to the PM while he or she is in office; the PM can be investigated after his or her term is completed.
There will be a seven year limitation period on Lokpal that is to say there shall be a seven-year limitation period for complaints. So the Lok Pal will not investigate a complaint over seven years after it is made.

The Lokpal or ombudsman will have a Chairperson and eight members - 50 per cent of them will be from the judiciary as will the chairperson, who has to be a serving or retired Chief Justice of India or Supreme Court judge. The non-judiciary members have to be "persons of impeccable integrity and outstanding ability,"

Jokepal Bill or the Lokpal bill does not bring all the politicians under lokpal.
The bill says only those in rank of deputy and joint secretary should be included. The investigation will be independent and time bound.

The removal of the Lokpal will be the prerogative of the President of India.

Who is the boss of President?
As per Indian constitution President of India is a rubber stamp of Prime Minister, thus Prime Minister can remove Lokpal whenever he wishes.
Thus Lokpal has become another servant of Prime Minister and his team which includes majority time’s criminals.

Under this government lokpal bill following type of corruption and scams are not covered

1. Adarsh Housing scam

2. the Commonwealth Games scam

3. the Reddy brothers scam

4. mining scam

5. Jharkhand Mukti Morcha scam

6. Cash for vote scam

7. fodder scam

8. Taj corridor scam

Such type of scams will not be investigated by government Lokpal so now tell me which corruption government is planning to stop?

Justice delayed is Justice denied.
Indian constitution also got defeated as Prime Minister got special right which no other Indian enjoys.

The Lokpal Bill will now be introduced in Parliament in the monsoon session which begins on Monday.

Objective of the Lokpal Bill is this –
To check corruption within politicians and bureaucrats.
When Lokpal is the servant of Politicians how he can investigate properly criminal politicians?

This is the big opportunity for BJP to win the billions of votes by supporting Anna.
And the Jan Lokpal Bill.

If BJP supports government of Congress then BJP won’t win the next elections.
