As part of the campaign, Moorkoth has appealed to Mumbaikars to join him in collecting monthly bills for expenses incurred owing to potholes.

He intends to present these bills to the civic chief shortly, so he can forward them to contractors who have failed miserably in making good their many promises of repairing potholes properly.

This means that next time if you suffer losses because of path holes, like you damage your car and have to spend money on repair send the bill to the BMC.

Understand, Know Complete draft of NATIONAL LAND ACQUISITION
AND REHABILITATION & RESETTLEMENT BILL, 2011

The government on Friday released the draft Land Acquisition Bill prepared by rural development minister Jairam Ramesh which seeks to enhance compensation for landowners by up to six times, provides annuity-based payment for 20 years and limits the use of urgency clause to the "rarest of rare cases".


The draft Bill is being placed in the public domain as part of a pre-legislative consultative process. Comments are invited preferably before August 31st, 2011. Separately, the Ministry of Rural Development has launched initiatives to update and digitize land records and to move from a presumptive system to a conclusive system of land records.

Under our Constitution, land is a State subject but land acquisition is a Concurrent subject. So far, the basic law governing the land acquisition process has been the Land Acquisition Act, 1894. Although it has been amended from time to time, it is painfully evident that the basic law has become archaic.

Land Acquisition and Resettlement & Rehabilitation need to be seen necessarily
As two sides of the same coin

LA = Land Acquisition
RR = Resettlement & Rehabilitation

1. This draft Bill seeks to balance the need for facilitating land acquisition for various public purposes including infrastructure development, industrialization and urbanization, while at the same time meaningfully addressing the concerns of farmers and those whose livelihoods are dependent on the land being acquired.

2. The objective is to make the process of land acquisition easy, transparent and fair for both sides in each instance.

3. The draft Bill is fully compliant with the provisions of (i) PESA,1996; (ii) Forest Rights Act, 2006; and (iii) Land Transfer Regulations in Schedule V (i.e., tribal) areas

4. There are 18 other laws of the Central Government for land acquisition (like for highways, SEZs, defence, railways etc). The draft Bill will enjoy primacy over other such specialized legislations that are currently in force.

5. This is the first National/ Central Law on the subject of Resettlement and Rehabilitation of families affected and displaced as a result of land acquisition

6. The Central Government shall constitute a National Monitoring Committee for reviewing and monitoring the implementation of rehabilitation and resettlement schemes or plans under this Act.

7. The State Government shall, for the purpose of providing speedy disposal of disputes relating to land acquisition, compensation, Rehabilitation and Resettlement establish, by notification in the Official Gazette, an Authority for the State to be known as the (name of the State) Land Acquisition Dispute Settlement Authority to exercise the jurisdiction, powers and authority conferred on it by or under this Act with regard to acquisition of land by the State Government:

The Central Government shall, for the purpose of providing speedy disposal of disputes relating to land acquisition, compensation, Rehabilitation and Resettlement establish, by notification in the Official Gazette, an Authority for the Centre to be known as the National Land Acquisition Dispute Settlement Authority to exercise the jurisdiction, powers and authority conferred on it by or under this Act with regard to acquisition of land by the Central Government:

9. Whoever willfully obstructs any person in doing any of the acts authorized by section 9 or section 15, or willfully fills up, destroys, damages or displaces any trench or mark made under section 15, shall, on conviction before a Magistrate, be liable to imprisonment for any term not exceeding one month, or to fine not exceeding five hundred rupees, or to both.

10. Whenever the ownership of any land acquired under this Act is transferred to any person for a consideration, twenty per cent of the difference in the acquisition cost and the consideration received, which in no case shall be less than the acquisition cost, duly adjusting for development cost shall be shared amongst the persons from whom the lands were acquired or their heirs, in proportion to the value at which the lands were acquired, and for the purpose, a separate fund may be maintained which shall be administered by the Collector in such manner as may be prescribed.


Scope of LAND ACQUISITION AND REHABILITATION & RESETTLEMENT BILL, 2011
Both LA and R&R Provisions will apply when:

1. Government acquires land for its own use, hold and control

2. Government acquires land with the ultimate purpose to transfer
It for the use of private companies for stated public purpose (including PPP projects but other than national highway projects)

3. Government acquires land for immediate and declared use by private companies for public purpose

Note I: Public purpose for 2. & 3. above, once stated, cannot be changed

Note II: Land Acquisition under 2. & 3. above can take place provided 80% of the project affected families give consent to the proposed acquisition.

Only R&R provisions will apply when:
1. Private companies buy land, equal to or more than 100 acres, on their own;

2. Private company approaches Government for partial acquisition for public purpose.

Note: Government does not envisage acquiring:
1. Land for private companies for private purposes.
Or
2. Any multi-crop irrigated land for public purposes

The following categories are considered as public purpose:

1. Strategic purposes: e.g., armed forces, national security

2. Infrastructure and Industry: where benefits largely accrue to the general public

3. Land acquired for R&R purposes

4. Village or urban sites: planned development -residential purpose for the poor and educational and health schemes

5. Land for private companies for public purpose

6. Needs arising from natural calamities

The Urgency Clause can only be invoked in the following cases:

1. National defense and security purposes

2. R&R needs in the event of emergencies or natural calamities

3. To be exercised in ‘rarest of rare’ cases

Salient Features of the Draft Bill –

Land Owners:
1. Family whose land/other immovable properties have been acquired

2. Those who are assigned land by the Governments under various schemes

3. Right holders under the Forest Rights Act, 2006

• Livelihood Losers:
1. A family whose livelihood is primarily
dependent on the land being acquired
2. May or may not own property

A Comprehensive Compensation Package (Schedule I)
1. Market value of the land:
a) the minimum land value, if any, specified in the Indian Stamp Act, 1899 for the registration of sale deeds in the area, where the land is situated; or

b) the average of the sale price for similar type of land situated in the village or vicinity, ascertained from fifty per cent of the sale deeds registered during the preceding three years, where higher price has been paid; or whichever is higher:

PROVIDED THAT THE MARKET VALUE SO CALCULATED
SHALL BE MULTIPLIED BY THREE IN RURAL AREAS.

2. Value of the assets attached to land: Building/Trees/Wells/Crop etc as valued by relevant govt. authority;
Total compensation = 1+2

3. Solatium: 100% of total compensation

This implies that in case of urban areas, the award amount would be not less than twice that of the market value determined, whereas in rural areas it would be not
less than six times the original market value

A Comprehensive R&R Package (Schedule II and Draft Bill)
For Land Owners:

1. Subsistence allowance at Rs. 3000 per month per family for 12 months

2. Rs 2000 per month per family as annuity for 20 years, with appropriate index for inflation

3. If house is lost, a constructed house of plinth area of 150 sq mts of house site in rural areas or 50 sq mts plinth area in urban area

4. One acre of land to each family in the command area, if land is acquired for an irrigation project

5. Rs 50,000 for transportation

6. Where land is acquired for urbanization, 20% of the developed land will be reserved and offered to land owners, in proportion to their land acquired

7. Upon every transfer of land within 10 years of the date of acquisition, 20% of the appreciated value shall be shared with the original owner whose land has been acquired

8. Mandatory employment for one member per affected family or 2 lakh rupees if employment is not offered

9. Offer of shares up to 25% of the Compensation amount

A Comprehensive R&R Package (Schedule II)

For Livelihood losers (including landless):

1. Subsistence allowance at Rs. 3000 per month per family for 12 months

2. Rs 2000 per month per family as annuity for 20 years, with appropriate index for inflation

3. If home-less, a constructed house (plinth area) on 150 sqmts of house site in rural areas or 50 sqmts in urban area, provided free of cost

4. A one-time ‘Resettlement Allowance’ of Rs 50,000

5. Rs 50,000 for transportation

6. Mandatory employment for one member per affected family or 2 lakh rupees

Special Provisions for ST’s

1. One acre of land to each ST family in every project

2. One time financial assistance of Rs 50,000 for ST families

3. ST families settled outside the district shall be entitled to an additional 25% R&R benefits (and a one time payment of Rs 50,000) to which they are entitled in monetary terms

4. Payment of one third of the compensation amount at very outset to ST families

5. Preference in relocation and resettlement in area in same compact block

6. Free land for community and social gatherings

7. In case of displacement of 100 or more ST families, a Tribal Displacement Plan is to be prepared: -Detailing process to be followed for settling land rights and restoring titles on alienated land; -Details of programme for development of alternate fuel, fodder and non-timber forest produce.

Minimum R&R Entitlements -
Continuation of reservation and other benefits from
displaced area to resettlement area for both SCs and STs

25 infrastructural amenities to be provided in the Resettlement area
Following are the 25 infrastructural amenities to be provided in the Resettlement area

1. Roads within the resettled villages and an all-weather road link to the nearest pucca
road, passages and easement rights for all the resettled families be adequately arranged.

2. Proper drainage as well as sanitation plans executed before physical resettlement.

3. One or more assured sources of safe drinking water for each family as per the norms prescribed by the Government of India

4. Provision of Drinking water for cattle

5. Grazing land as per proportion acceptable in the state

6. A reasonable number of Fair Price shops

7. Panchayat Ghars, as appropriate

8. Village level Post Offices, as appropriate, with facilities for opening saving accounts

9. Appropriate seed-cum-fertilizer storage facility if needed

10. Efforts must be made to provide basic irrigation facilities to the agricultural land
allocated to the resettled families if not from the irrigation project, then by developing
a cooperative or under some government scheme or special assistance

11. All new villages established for resettlement of the displaced persons shall be
provided with suitable transport facility which must include public transport facilities
through local bus services with the nearby growth centres/urban localities

12. Burial and/or cremation ground, depending on the caste- communities at the site and
their practices

13. Facilities for sanitation, including individual toilet points

14. Individual single electric connections (or connection through non-conventional
sources of energy like solar energy), for each household and for public lighting

15. Anganwadi’s providing child and mother supplemental nutritional services

16. School as per the provisions of Right to Education Act

17. Sub health centre within two kilometre range

18. Primary Health Centre as prescribed by the Government of India

19. Playground for children

20. One community centre for every 100 families

21. Places of worship and chowpal/ tree platform for every 50 families for community assembly, of numbers and dimensions consonant with the affected area

22. Separate land must be earmarked for traditional tribal institutions

23. The forest dweller families must be provided, where possible, with their traditional rights on non-timber forest produce and common property resources, if available close to the new place of settlement and, in case any such family can continue their access or entry to such forest or common property in the area close to the place of eviction, they must continue to enjoy their earlier rights to the aforesaid sources of livelihood

24. Appropriate security arrangements must be provided for the settlement, if needed

25. Veterinary service centre as per norms

Safeguards against indiscriminate acquisition –

Social Impact Assessment made mandatory where area to be acquired is equal to or greater than 100 acres;

• Chief Secretary Committee to approve ‘public purpose’ and approve the SIA report;

• Draft Notification to include:
– Summary of SIA
– Particulars of Administrator for R&R who prepares R&R scheme

• Draft Declaration to include:
– Summary of R&R package

• Return of Land: Land returned to original owner if not used in 5 years for the purpose for which it is acquired, one-fourth of the award amount for the land acquired– Provided government can use land acquired for a department to some other department

Transparency Provisions –
Social Impact Assessment
– Gram Sabha to be consulted
– Summary of SIA notified along with Draft Notification
– SIA document made available for public scrutiny

• R&R Scheme
– Summary notified along with Draft declaration
– Made available for public scrutiny

Penalties –
Punishment for false information, Mala Fide action, etc
• If False or Misleading Documents: Will result in the levy of a fine of up to one lakh rupees and/ or with imprisonment up to a month.

• If R&R benefits obtained on false information: Shall be recovered by the Appropriate Authority.

• Disciplinary Proceedings against Govt. Officers: A Government servant who is guilty of a mala fide action in respect of any provision of this Act and he shall be liable to such punishment (and fine) as the disciplinary authority may decide.

Awards –
Collector passes 2 types of Awards:
1. Award for Land Acquisition
– Award made in respect of every affected family whose land is being acquired and containing details of LA compensation as listed in Schedule I;

2. Award for R&R
– Award made in respect of every affected family, regardless of whether they may be losing land or not, containing details of R&R entitlements as listed in Schedule II.
Provided that Land will not be transferred until R&R is completed

The Collector shall ensure that full payment of compensation as well as rehabilitation and resettlement entitlements are paid or tendered to the entitled persons within a period of three months for the compensation and a period of six months for the rehabilitation and resettlement entitlements

The Land Acquisition Act 1894 as amended from time to time is hereby repealed.

Advertising Standards Council of India (ASCI) has asked Hindustan Unilever and Paras Pharma to pull their objectionable deodorant commercials off air.
The complaints upheld against three deodorant advertisements include


1.
The Hindustan Unilever Ltd’s The Axe Effect advertisement - The Hindustan Unilever Ltd’s The Axe Effect advertisement - depicting a female security staff checking a man at an airport with a metal detector on his chest and arms. She is shown in a spell of lust and clinging to his body in a display of sexual passion overpowering her with the voice-over, “The Axe Effect”.

Paras Pharmaceutical’s Zatak Axe Deodorant - shows a boy going to a lady dentist after using the Deo. As he sprays the deodarant, the lady dentist is shown closing her eyes and moaning suggestively. When the boy says that he has toothache, the lady dentist is shown unbuttoning his shirt. She asks him to breathe and demonstrates it by sensuously thrusting her bust forward. In doing so, her white coat is off and her inner garment is clearly showing off her cleavage.

Paras Pharmaceutical’s Set Wet Deodorant advertisement - shows a man using the Deodarant and a female clinging to him in a passionate display of desire. An onlooker also tries the deodorant and soon a female is shown coming behind him taking off her garment and clinging to him lustfully.


The consumer complaints council of ASCI that is CCC in a meeting which was recently held concluded that these advertisements display overtly sexual desire and are also demeaning to women.
Keeping in view the generally prevailing standards of decency and propriety is likely to cause grave and widespread offence.
Since these advertisements contravened Chapter II of the ASCI Code, the complaints against these three advertisements have been Upheld.

During the meeting, CCC also noted Paras Pharmaceutical’s assurance that the Zatak Axe TVC would be appropriately modified.

once a complaint is upheld, the advertiser has to pull off the commercial within 48 hrs and then he/she has the option of either modifying it or completely withdrawing it.

The CCC during the same meeting did not upheld complaints against 4 deodarant advertisements

McNROE Consumers Products P. Ltd’s Wild Stone Deodorant - showing a woman who is blindfolded gradually removing her blindfold to cast a sensuous look at a man and then again putting it on. Thereafter, she is shown sensuously groping for the man. The woman is then shown removing her saree off in a seductive gesture, as the man is shown spraying the Deo on his body.

Kerala High Court orders Air India to pay damages of Rs.75 Lakh each to Mangalore Air Crash victim’s families

22 May 2010 –
Air India Express (budget airline of AI) Boeing 737-800 aircraft from Dubai carrying 166 people crashed outside Bajpe Airport in Mangalore (Karnataka) and burst into flames after overshooting a table-top runway. Mangalore Air crash killed 158 Passengers.

The flight's cockpit voice recorder data showed that the instrument had picked up snoring sounds indicating that the Serbian pilot Captain Zlatko Glusica had slept off for about 90 minutes and failed to pull up the plane after it lost control. He also ignored advice of his co-pilot.


After this accident national carrier Air India (AI) and insurance consortium tried to settle the case offering compensation based on the income of the deceased.
Majority victims belong to low income group and thus compensation amount offered to them was ranging between Rs.15 Lakh to Rs.35 Lakh Maximum.

Abdul Salam, who lost his son Mohamed Rafi (24) in the crash, was offered compensation of Rs.35 Lakh only but Abdul filed a case in a High court as compensation offered was very less. They said that they are entitled to get Rs.1.5 Crore as damages as per International rules and norms.

Families of the deceased had floated an organization, Mangalore air crash victims' Families Association, to fight their case.

After that Kerala high court ordered national carrier Air India (AI) to pay Rs 75 lakh each to families of the Mangalore air crash victims.
The court directed Air India to pay the compensation in a month's time
Justice P R Ramachandra Menon said Air India was liable to pay the compensation equivalent to 1 lakh Special Drawing Rights (SDR).

The compensation is one of the highest to be paid by the airline.

Special Drawing Rights (SDR) is a kind of International Monetary Fund currency
The SDR is a mix of currency values established by the International Monetary Fund (IMF). As per the current value, one lakh SDR adds up to Rs.75 lakh.

The Montreal Convention, signed under the aegis of International Civil Aviation Organisation (ICAO) in 1999, establishes rules concerning compensation for the victims of air disasters. The convention protects passengers' rights to claim compensation from either the airline or a third party like insurance companies.
India has signed the Montreal Convention.

The payout would be distributed over one year and will cost the cash-strapped carrier about Rs 118 core.

The petitioners' lawyer, Kodoth Sreedharan, said, "The court has given a direction (to Air India) to pay no fault liability of 1 lakh SDR with the balance compensation (whatever is claimed) within a month."

The study report found that 87% of Indian women said they felt stressed most of the time, with 82% claiming they had no time to relax.

Women in developed countries spend their cash on vacations, savings and paying off debt.

Report also found that women in developing countries think that their daughters will have more opportunities than they had, while women in developed nations believe their daughters will only have the same opportunities as they had.

Three blasts rocked Maharashtra's Mumbai city on the 24th birthday of Ajmal Kasab, the lone surviving terrorist of the 26/11 terror attacks, on Wednesday.

Mumbai once again witnessed the 3 bomb blast.
two in South Mumbai at Opera House and in Zaveri Bazar and one at Dadar West, in central Mumbai.


All 3 blasts took place during rush hour and in crowded places which killed 21 and injured 113. The injured were admitted to several hospitals including the JJ Hospital, GT Hospital, KEM Hospital and St George's Hospital.

The first blast took place at 6:54 PM at south Mumbai's crowded Zaveri Bazaar.
The Zaveri Bazaar blast took place in an umbrella kept at the crowded Kahu Gali, a street of eateries where many commuters stop to snack before catching their local train’s home.
This was the third blast in zaveri bazaar in last 18 years.

The second bomb blast took place at 6.55 PM Opera House which was "high intensity blast".
A motorcycle was used to trigger the explosion near the two-storey JK Building at Tata Road No. 1 in Opera House

Third blast took place at 7.05 PM at Dadar.
The blast at Kabootar Khana in Dadar took place in a Maruti Esteem car.

NIA (National Investigation Authority) officers will help Mumbai police in all these 3 bomb blast.
One CFSL (Central Forensic Science Laboratory) team from Delhi and one team from Hyderabad have been sent to Mumbai.
A Border Security Force plane carrying NSG personnel, forensic experts and senior NIA officials reached Mumbai from New Delhi on Wednesday night.

Mumbai Police Commissioner Arup Patnaik claimed that he was not in a position to say who carried out the blasts.

The Home Minister said Improvised Explosive Devices (IED) were used in all three blasts.

US President Barack Obama said that "I strongly condemn the outrageous attacks in Mumbai," "India is a close friend and partner of the United States. The American people will stand with the Indian people in times of trial, and we will offer support to India's efforts to bring the perpetrators of these terrible crimes to justice,"

Prime Minister Dr Manmohan Singh said that "I strongly condemn the bomb blasts in Mumbai this evening. I have asked the Chief Minister of Maharashtra to do whatever is possible to provide relief to the injured and to the families of the deceased citizens. But Erode District Collector R Anandhakumar dared to do which no educated Indian is ready to do; He enrolled his daughter in a Panchayat school, a government school.

Last week Erode District Collector R Anandhakumar alone with his wife and daughter visited Tamil medium school at Kumuilankuttai and met the headmistress and enrolled his six-year-old daughter A Gopika after completing due formalities.

According to school authorities, collectors daughter will be given free midday meal as wished by the Collector.

After her admission now school authorities will be required to improve themselves as the daughter of collector is studying in their school.

The Collector, a veterinarian, has told the school authorities to treat his daughter as any other child and allow her to mingle with other students.

Erode District Collector R Anandhakumar declined to speak about his decision to enroll his daughter in the Panchayat School.

India needs a law which will make it compulsory for all the government officers and politicians to enroll their kids in government school including IAS, IPS or any type of government official.

And if any government official or politician, law maker breaks this law automatically his job should get terminated permanently.

Understand the meaning of government suspension, let the citizens of India forget the matter we will give you your job back to do more corruption.

Planning Commission told the Supreme Court on Tuesday that a city dweller cannot be termed poor if his average monthly spends exceed Rs 31 on rent and conveyance, Rs 18 on education, Rs 25 on medicines or Rs 36.5 on vegetables. I t said these were the average monthly expenditure levels per capita across the country it was using to decide the official 'poverty line'


The government's eligibility criteria for the rural poor is even more stringent.
If a villager spends more than Rs 15 a day he is not poor, according to the Plan panel's statisticians

The commission has declared that only 41.8% of the rural population is poor and a mere 25.7% of the urban Indians need food, shelter and social benefits from the government.

What this ration means how and it will affect the Indian citizens?
Anyone spending more than half American dollar that is Rs. 15 and Rs.20 will be denied subsidized food, accommodation, pensions and medical treatment targeted at the BPL population.

If Indian citizens can live daily by earning half a American dollar then why Politicians get there salaries increased?

An urban Indian spending more than Rs 578 a month roughly Rs 20 a day on all his basic needs cannot be termed poor and would not receive social benefits and subsidies given by the Centre to BPL citizens, the Planning Commission has said.

I hope few politicians will spend a month by showing us Indians how to live daily in Rs.20.

I hope any Reality TV show will get this idea and start a reality show where contestants will be given daily Rs.20 and will be told to live as they want.

Ulhasnagar civic body has not given permission to the single tower in Ulhasnagar.

Nearly 200 towers are installed in on the terrace of several Ulhasnagar buildings, posing health hazards to lakhs of residents, are illegal.



The civic body officials say that they do not have power to take action against the offenders.

UMC's health department official S Pawar said that "The civic body has not given permission to a single tower situated in Ulhasnagar, so all the towers installed in the area are illegal,"

According to Prem Jha, an RTI official in Ulhasnagar, "If these mobile towers were granted permission as per the rule, the UMC coffers would have been filled from the crores of rupees collected from the service providers.

Ashok Kumar Rankhamb, the UMC commissioner, said, that we have sent a letter to the High Court on April 20 seeking orders to demolish these illegal towers. We are waiting for the reply. As and when we get the order, we will take action immediately."

Benazir Bhutto had just addressed a rally of Pakistan Peoples Party supporters in the city of Rawalpindi when the rally was rocked by a blast.
Bhutto was leaving the rally when the attack occurred.
Gun shots were fired at Benzir Bhutto after a political rally at Liaquat National Bagh, and a suicide bomb was detonated immediately following the shooting.
She was declared dead at 18:16 Pakistan Time at Rawalpindi General Hospital.

Investigation by Scotland Yard found that while gunshots were fired,
They were not the cause of death, agreeing with the Interior Ministry's original assessment that the explosion forced her head into the roof of the vehicle.

Benzir Bhutto left Pakistan because of corruption charges and stayed outside that is in London and Dubai for seven years, after seven years Bhutto returned to Karachi on 18 October 2007 to prepare for the 2008 national elections, allowed by a possible power-sharing deal with President Pervez Musharraf

So what we are supposed to do on 15th March –
Remember 15th March is No Purchase day so do not purchase anything from any shop or mall.
Do not spend a single Rupee Dollar.
What ever you need purchase it on 14th March 2011.

Do not forget 15th March is No Purchase Day

Stay Home Do whatever you like

I will suggest call all your friends and tell them about 15th March 2011 its no purchase day.

Remind them not purchase anything on 15th March.

If you are shop owner Please think for India if possible take a half day holiday or Keep your shops close in support of No Purchase Day.
