Atanasio Babush Monserrate under customs and FEMA act –
Last week at Mumbai Airport the Air Intelligence Unit (AIU) detained Goa's Education Minister, Atanasio Babush Monserrate for carrying undeclared foreign currency
AIU officials said that minister was carrying foreign currency worth Rs 1 crore and 80,000. Apart from that, he was also carrying Rs 24 lakh.
Customs department questioned more than six hours to Goa's Education Minister, Atanasio Babush Monserrate on Saturday.
Customs department wanted to know from him why he was carrying about Rs 25 lakh worth unaccounted cash?
But he did not answer or failed to explain customs department then customs department registered a case against him under the Customs and the Foreign Exchange Management Act.
But Goa Chief Minister Digambar Kamat, whose government has a slim majority, has been backing Monserrate.
in 2006 Monserrate was accused of altering Goa's land development plan in favor of the builder lobby. Public outrage on the issue forced him to resign as minister of town planning.
In 2008, Monserrate was arrested for attempted murder after he and his supporters attacked a police station in Panjim, injuring 32 policemen
Monserrate's 21-year-old son Rohit was charged with raping a German minor girl. But the girl's mother later withdrew the complaint and Rohit Monserrate walked free.
Under FEMA the citizen caught with excess money is only liable to pay three times the excess amount as fine.
Normally rich citizens or corrupt get caught before FEMA there was FERA under which there was punishment of Imprisonment but under FEMA there is no such punishment.
Under customs act Babush may face imprisonment.
